BUYER BEACON, LLC TERMS OF SERVICE
The Terms of Service described herein provide information on the use of BuyerBeacon.com. Please read completely these Terms of Service, Privacy Policy and Terms and Conditions. Your use of the Service constitutes agreement to these Terms of Service, the Terms and Conditions, and Privacy Policy. Buyer Beacon, LLC, a Michigan Limited Liability Company has a principle place of business located at 920 Old Hickory Trail, Lake Orion MI 48362. Buyer Beacon, LLC is not a Real Estate Broker, mortgage broker or lender and Buyer Beacon, LLC does not aid or assist borrowers in obtaining, solicit borrowers of lenders for, negotiate or make loans secured by liens on real property. Buyer Beacon, LLC is not a member of any multiple listing services (MLS) and does not list any real estate on any MLS. BuyerBeacon.com does not represent or warrant the condition of any property listed. Buyer Beacon, LLC reserves the right to modify or update this agreement at any time without prior notification. Your continued use of the service constitutes agreement to the terms in place at the time. This agreement was last revised on March 11, 2008.
Definitions: BuyerBeacon.com will be referred to as the “Web Site”, “Customers” refers to users who purchase any product or service on BuyerBeacon.com and “you” refers to users of BuyerBeacon.com. Any references to “us”, “we”, or “our” refer to Buyer Beacon, LLC which is the owner and operator of this Web Site. The term “service” refers to the Web Site offered for customers to use in selling or buying a home or property.
Description of Service: BuyerBeacon.com is designed to assist homeowners, property owners, and certified realtors, in marketing their property to potential buyers by providing sellers a marketplace to list their home and properties. The site is also designed to aid homebuyers in identifying a home for purchase. Communication within the Web Site is restricted to email use. There is no charge to list one (1) home, property, or create a buyer profile. Subscription rates apply to BuyerBeacon.com e-mail services when communication is desired with potential buyers of the home or property or if a user desires additional home or property listings. For more information of the subscription fees please see the Terms and Conditions item 4 “Customer Responsibilities”.
Registration: When you register with BuyerBeacon.com, you are responsible for all activities under your ID and password, and agree not to transfer, sell or assign your subscription to the service. Confidentiality of your user information is your responsibility. If you become aware of anyone using your sign on information please contact us immediately at support@buyerbeacon.com.
Restrictions: BuyerBeacon.com is intended for personal use and is not intended to be used for any commercial reasons whatsoever. “Commercial” as defined is for the use of advancing a business interest. Use of the Web Site is for the communication of homes and properties listed on this Web Site and information regarding the users of this Web Site is not to be used elsewhere for any purpose.
Except with the express written permission of Buyer beacon, LLC, you agree that you will not access or attempt to access password protected, secure or non-public areas of BuyerBeacon.com.
Customer Provided Information: You agree that all information placed on BuyerBeacon.com is accurate and complete. It is free from profanity and is not considered offensive, vulgar or racial. Unless otherwise requested on the Web Site, your name will be your legal name and all contact information accurate and kept up to date, including billing information. BuyerBeacon.com reserves the right to share information across web sites for purposes of marketing. Posting Guidelines: It is required that all information posted on BuyerBeacon.com meets the criteria contained in the Terms and Conditions and Terms of Service and does not violate any laws or ordinance. BuyerBeacon.com does not monitor all information posted or transmitted by users and third party providers, however all communication on the Web Site is logged and any improper solicitation or illegal use may be a cause for immediate termination or legal action. BuyerBeacon.com reserves the right to modify or remove any information we consider inappropriate or in violation of our policies. At our discretion, we reserve the right to restrict or cancel the service at any time if violations occur.
Transactions: Initial payments and transactions will be handled via an on-line payment process. Subsequent monthly plan payments will be billed automatically to the credit card on record until services are cancelled or an account has been deemed inactive for a period of one (1) year. While most transactions occur without problems and Buyerbeacon.com uses standard security measures to protect transactions and financial information, we cannot take responsibility for transactions processed by third parties.
Mortgage Tools: BuyerBeacon.com may provide financial or mortgage tools that provide information and customer information based on user-inputted data. These tools are for the purpose of performing calculations, and are not an offer to lend. Interest rates shown are for demonstration purposes only.
Governing Law: The laws of the State of Michigan, United States of America will govern the terms of this service. International users are required to make certain that any use of the Web Site or contents thereof is not a violation of the laws governing their country or territory in which access is being requested. Buyer Beacon, LLC shall not be held liable for any such violations of use.
Disputes: You agree that any disputes be handled in accordance with Buyer Beacon, LLC Terms and Conditions Item 10 “Buyer Beacon, LLC Information and Requirements”. You agree that any claim or cause of action you may have with respect to BuyerBeacon.com is filed in a federal or state court located in Oakland County, Michigan within two (2) months of the time in which reason for such dispute first occurs. You agree that no such claim be brought as a class action.
Copyright and Use: Information and content on BuyerBeacon.com including home or property listings, photos and any information used to portray a listing or trademarks is owned by Buyer beacon, LLC. Use of the content by customer is on-line only and strictly for personal non-commercial use. Any request to use any of the information such as republishing or distributing must be made and agreed to in writing by contacting us at support@buyerbeacon.com
Links to Other Web Sites: If you operate a web site it is permissible to add a link to BuyerBeacon.com but at the discretion of BuyerBeacon.com you may be asked to terminate the link. Absolutely no links to other websites can be added to your listing or you will be subject to liquidated damages in the amount of $10,000 (see Buyer Beacon, LLC Terms and Conditions, “Customer responsibilities” for more information.
Third Party Activity: Buyer Beacon, LLC will not be responsible for dealings with third party web sites. Your purchases of goods and services or participation in any contest or sweepstakes are strictly between you and them and any problems or concerns need to be directed to the third party.
