BUYER BEACON, LLC TERMS AND CONDITIONS

Buyer Beacon, LLC is a Michigan limited liability corporation with a principle business location of 920 Old Hickory Trail, Lake Orion, MI 48362 and providing services/products offered on the BuyerBeacon.com Web Site.  By using the website you agree to the terms listed and are fully bound by them.  Your use of the web site also requires that you acknowledge that no signatures are required to be fully bound by these terms and conditions. You agree that, without notice to you, we may terminate your user access, Customer Account and password to the web site services if we feel that there are any violations of these terms. You agree that no joint venture, partnership, employment, or agency relationship exist between you and Buyer Beacon, LLC as a result of the Terms of Use or accessing or using BuyerBeacon.com.  This Agreement was last revised on March 11, 2008.
Definitions: BuyerBeacon.com will be referred to as the “Web Site’,” Customers” refers to users who purchase any product or service on BuyerBeacon.com and “you” refers to users of BuyerBeacon.com.  Any references to “us”, “we”, or “our” refer to Buyer Beacon, LLC which is the operator and owner of this Web Site.  The term “service” refers to the Web Site offered for customers to use in selling or buying a home or property.
Customer Responsibilities:  It is expected that all information provided during the registration process will be accurate and true and kept up to date at all times.  You must be 18 years of age or older and guarantee the accuracy of information submitted.  You are solely responsible for mistakes or omissions.  You also agree that the use of the services of this website is for personal use.  No commercial use of this web site is permitted, including adding links to other websites in your listing.  Adding a link to any web site in your listing or personal profile will violate the terms of this agreement and subject you to liquidated damages in the amount of $10,000.  From time to time we may change or update the Terms without prior notification to you.  Each time you access the Web Site the Terms and Conditions in place at that time will govern the use of the Site.

1. Account Registration and Access:  By opening an account at BuyerBeacon.com you agree to accept responsibility for all activity initiated under your password.  Transferring your account is not permitted.  Only one household per account is permitted.  You are responsible to protect your password and account information.  Violations of this will cause immediate termination.  We may also terminate your account if it is inactive for a period of one year.
2. Fees:  You must agree to pay all charges or fees associated with your account, user name and password.  Fee responsibility includes charges incurred to gain access to BuyerBeacon.com through a third party service or Internet provider.
3. Secured Access:  Except with the express written permission of Buyer Beacon LLC, you agree that you will not access or attempt to access password protected, secure or non-public areas of BuyerBeacon.com.  Further, please note that certain of the interactive Services may be financial or mortgage tools that provide information and customized information based on user-inputted data.  These tools are for the purpose of performing calculations, and are not an offer to lend.  Interest rates shown are for demonstration purposes only.  Actual market rates may vary.
4. Subscription Fees:  Registration for the Monthly Plan requires a monthly subscriber fee of $10.95 payable by a registered credit card and automatically billed to that card every thirty days from the date the ad is placed until the user satisfactorily cancels the ad.  This payment will be considered an automatic credit card debit.  Prices quoted in these Terms and Conditions are for Internet Subscriptions only.  Prices may vary depending on specials, discounts or rebates or subject to change without notice.  Please contact us at support@buyerbeacon.com with any questions or concerns.
5. Listing Cancellation:  Cancellation can be performed online or by sending and e-mail at least two (2) business days prior to request date for cancellation.  Send e-mail cancellation request to support@buyerbeacon.com.  Please title the e-mail “Cancellation Request” and include your username and password.  Confirmation of the cancellation will be sent by us via e-mail by end of business day of cancellation date request or your listing will not be cancelled.  If no confirmation is received then cancel your listing online.  To cancel your listing online login at www.buyerbeacon.com using your username and password.  Click on “Edit Preferences”.  Then click “Close my Account”.  Clicking the “OK” button will cancel your property listing instantly and provide on-screen confirmation.  If you do not receive confirmation then contact us at support@buyerbeacon.com.  Once cancellation is complete, your credit card will no longer be billed.  Cancellation of an Internet listing on BuyerBeacon.com has no affect on an affiliate publication, publication listing, or MLS listing.  It is the subscriber’s responsibility to confirm that their ad has been cancelled to avoid further billing.
6. Adding a Listing:  Additional Listings can be added to your personal listing for a monthly subscription fee of $5.95 per month per additional listing in addition to their monthly fee of $10.95 per month.  Additional listing fees will be automatically billed every thirty (30) days from the date the ad is placed.  Payment will be automatically billed to credit card on record.  To cancel any additional listings please follow the procedures outlined in Listing Cancellation Item 5.
7. Upgrades:  BuyerBeacon.com may offer from time to time upgrades to services that are subject to change without notice or be offered for a limited time.  Upgrades are subject to the Terms and Conditions contained in these sections.
8. Account Inactivity:  If an account remains inactive for a period of one (1) year all listings will be considered expired.  We will send an e-mail message 1-3 days prior to the expiration date informing you of pending cancellation.  You will have the opportunity to extend the account for an additional year.  Non-response to our e-mail or inactive e-mail account is your responsibility. Any concerns can be submitted to support@buyerbeacon.com.
9. Third Party Websites:  Buyer Beacon, LLC may provide your property listing as a service, to other third party websites as part of the monthly fees that you pay to us.  We may change without notice to you any of the third party web sites at any time.  There will be no other fees associated with this service.  However, Buyer Beacon, LLC will not be responsible for any third party web site that will not include your listing.  Furthermore, since the third party web sites are out of our control, we cannot guarantee that any particular third party listing will appear as desired.  By using our service you agree that Buyer Beacon, LLC has no liability whatsoever concerning the accuracy or display of any third party web site listing of your property.  Your dissatisfaction with any third party web site listing can only be remedied by canceling and discontinuing use of the BuyerBeacon.com service.
10. Other Third Party Affiliation:  If the customer gains access to the services provided by BuyerBeacon.com through an affiliate publisher, they must contact such affiliate publisher for billing inquiries.  Any billing issues must be remedied with the affiliate publisher and BuyerBeacon.com will not be responsible for any discrepancies.
11. Services Provided by Third Parties:  Any arrangements made through your services with BuyerBeacon.com with any other party are solely between you and the subject third party.  Buyer Beacon, LLC will have no liability regarding the cost of services or goods with such third party dealings or participate in any way as to negotiate such terms of any arrangements.  It is the Customers responsibility to make contact with and resolve any such disputed third party issues.

Refunds and Customer Responsibilities:  Buyer Beacon, LLC is under no obligation to provide a refund of any purchased product or service, but under certain limited circumstances, at the discretion of Buyer Beacon, LLC we may provide a complete or partial refund of said product or service.  It is the Customers responsibility to provide a timely request for cancellation and refund.

1. Cancellation Request:  Request for cancellation must be made within 24 Hours of your initial purchase of the service or product.  Your request must be in writing to BuyerBeacon.com and must specify the exact change requested.  Buyer Beacon, LLC may charge a $15 cancellation fee for services rendered.
2. Upgrades to Service:  You may upgrade your service at any time after your initial free account has been opened.  You will be required to pay the difference in price between the two options.
3. Request After 24 Hours:  There is no refund for request after 24 hours.  You may upgrade your plan after 24 hours but standard pricing applies.  Please contact support@buyerbeacon.com for pricing information.
4. Monthly Plan Cancellation Request:  All requests for cancellation of the Monthly Plan shall be carried out in accordance with “Customer Responsibilities” section 5.  There will be no pro-rated refund for canceling any Monthly Plan within the 30 day period.  You will be required to pay the full 30 day Monthly Plan cost.  This includes cost for additional listings.
5. Using E-Mail Service:  Use of our e-mail service to contact BuyerBeacon.com Customers, constitutes agreement to these Terms.  You agree to use the e-mail system only to contact other Customers/Sellers for purposes of communicating information related to the selling or purchase of listed property on BuyerBeacon.com.  You may not contact a customer of BuyerBeacon.com using our e-mail service to develop a commercial relationship or for solicitation of other goods or services. Violation of this section 5, “Refunds and Customer Requirements” is a violation of the Terms of this Agreement and you must compensate Buyer Beacon, LLC for Liquidated Damages in the amount of $1500 per occurrence.
6. Use of Personal Profiles:  By creating a personal profile using BuyerBeacon.com, you are agreeing to the terms in this section 6, “Refunds and Customer Requirements”.  You agree to use your personal profile to market only one property per account, unless you purchase an additional listing.  In no event may you market more than one property using one account if additional property listing space is not purchased.  You agree that violation of these Terms of this Agreement provides Buyer Beacon, LLC the right to immediately remove your profile, account, and access to the site.
7. Customer Information:  You agree that all information placed on BuyerBeacon.com is accurate and complete.  It is free from profanity and is not considered offensive, vulgar or racial.  Unless otherwise requested on the web site your name will be your legal name and all contact information accurate and kept up to date, including billing information.
8. Account Payment Information:  You agree to keep all billing information current regarding credit card information, billing address, zip code and other pertinent information required for automatic credit card debits.  Buyer Beacon, LLC will process the automatic payments based on the listed information and will not pursue obtaining updates to the billing information.  Inaccurate billing information will result in immediate termination of e-mail services and listings.
9. Computer Operating System Requirements:  It is the Customers responsibility to make certain that any computer used to gain access, post photos or utilize the website, be compatible with the operating system of BuyerBeacon.com, Including meeting minimum browser requirements (see below).  No refunds will be given for problems with your computer or peripheral access device.

Buyer Beacon, LLC Information and Requirements

1. Disruptions in E-Mail Service:  At times due to the technical and electronic nature of our service you may experience a temporary disruption of service.  Any disruption is not intentional and will be remedied as quickly as possible.  You will not receive a pro-rated refund for any period of service disruption.
2. Real Estate Services:  Buyer Beacon, LLC or BuyerBeacon.com services do not provide real estate broker services.  We are not a licensed real estate broker and do not use the MLS listing service.  At any time while using the Web Site BuyerBeacon.com users may encounter a real estate agent who is using the Web Site to list a property.  All real estate agents must disclose their profession within their seller profile.  BuyerBeacon.com has no affiliation with any realtor using the website and does not take part in any real estate transactions.  BuyerBeacon.com offers an e-mail service to users and that is the extent of the BuyerBeacon.com services.  If you would like to become part of the MLS service please consult a listing broker in your area for further details.  Buyer Beacon, LLC does not create, make author, write, print or otherwise produce any of the for-sale, bankruptcy or rental property listings that appear on BuyerBeacon.com.  All such property listings are produced and submitted to BuyerBeacon.com by others and BuyerBeacon.com shall not be held liable for any misinformation or representation of such.
3. Use of Information:  Buyer Beacon, LLC requires that you the Customer allow without exception and compensation the non-exclusive right and license to use, modify, post, display, distribute, reproduce and create information for website purposes any of the customer information provided in the listing(s) or your personal profile.  You authorize Buyer Beacon, LLC to share such information, including your name, across affiliated websites for marketing the material you provide.
4. Limits of Liability:  Buyer Beacon, LLC strives to keep the information on the website current and accurate.  However there may be times when accuracy of such information or data contains omissions or incorrect information.  Buyer Beacon, LLC will assume no liability for inaccuracy or omissions of information. If information is found to be inaccurate, please notify us at support@buyerbeacon.com so we may correct the discrepancies.  Buyer Beacon, LLC does not represent or warrant that the use of the services will not infringe on the rights of Third Parties and has no responsibility for information provided or posted by others. 
5. Disclaimers:  BuyerBeacon.com makes no warranties regarding the numbers and types of properties available for sale on the Web Site, or whether any property listed on the Web Site for sale will even be purchased.  We make no warranties regarding any of the terms a buyer or seller may or will obtain with respect to any property listed on the Web Site, the number of “hits” or page views of any property listed on the Web Site. Buyer Beacon, LLC makes no warranties whatsoever regarding the ownership, authority to sell, or condition of any property listed on the Web Site, or the sincerity or ability to pay of any potential buyer.  We make no warranties regarding communication between parties on the Web Site.  We make no warranties regarding the management of information on third party web sites.  We make no warranties regarding the quality of service provided by advertisers on the Site or the quality of goods and services they offer. We make no warranties regarding the ability of a Web Site user to access or use the Web Site or purchase services or goods made available on BuyerBeacon.com, for any reason or from any location. 
6. Use of Service:  BuyerBeacon.com makes no warranty regarding the use of the service.  BuyerBeacon.com is not responsible for any computer virus that may be transmitted through the use of the service.  It is highly recommended that current anti-virus software be installed on the computer used to access the services.  Use of service is at your own risk.  Buyer Beacon, LLC will not be held responsible for damages related to any loss of data or commercial opportunities or inaccuracy of information.
7. Indemnity:   You agree to indemnify, defend and hold harmless, Buyer Beacon, LLC it’s affiliates and perspective partners, suppliers, employees, representatives or agents or licensors, from any and all claims and damages, including attorney fees and court cost for any disputes relating to your use of BuyerBeacon.com or any information posted or transmitted through your account, even if not posted by you.  Liability amounts for direct damages will not exceed $100.
8. Privacy Policy and Terms of Service:  By using the service you expressly agree to be held to the Terms of Service and Privacy Policy for BuyerBeacon.com.
9. Governing Law:  The laws of the State of Michigan, United States of America will govern the terms of this service.  International users are required to make certain that any use of the Web Site or contents thereof is not a violation of the laws governing their country or territory in which access is being requested.  Buyer Beacon, LLC shall not be held liable for any such violations of use.
10. Disputes:  Disputes should be handled directly with Buyer Beacon, LLC by contacting us at www.support@buyerbeacon.com.  In the event resolution can not be obtained through normal means, Buyer Beacon, LLC may opt for settling though means of arbitration. Specific terms of arbitration will follow the guidelines of the American Arbitration Association and cost of arbitration at the discretion of Buyer Beacon, LLC.  Claims or disputes with Buyer Beacon, LLC must be initiated within one (1) year of when the dispute first arises or action will not be permitted.  If dispute goes to arbitration you agree to waive your right to a court proceeding and the dispute will be determined solely by use of arbitration.  You agree that any claim or cause of action you may have with respect to BuyerBeacon.com is filed in a federal or state court located in Oakland County, Michigan within two (2) months of the time in which such dispute first occurs.  You agree that no such claim be brought as a class action. 
11. Improvements to Service:  BuyerBeacon.com strives for continual improvement of services offered to our customers.  At times it may be necessary to temporarily suspend the service for updates to the Web Site.  BuyerBeacon.com will make every attempt to minimize the disruption to our customers.  You will not be entitled to any pro-rated refund for time lost for improvements to services.
12. Advertisements on BuyerBeacon.com:  BuyerBeacon.com provides advertising opportunities to Service Providers across multiple categories. Cost will vary per advertisement up to $35 per category and will be directly billed to the credit card on record every thirty days from the initial date the advertisement is placed on the Web Site.  Cancellation of the advertisement will follow the cancellation policy of listings in section 5 “Customer Responsibilities”.  BuyerBeacon.com will not be held liable for any advertising claims or accuracy of such information.
